From this year's CCC, two engineers look at the situation. In the first half, one talks about how ECU F/W is developed and other inside information about how cars are made. In the second half, the other one reverse engineers the code in a VW ECU and talks about the structure of the S/W and how it "cheats".
It's an hour long, but worth watching if you have the time.

Because of the way the requirements are developed and how things are tested, lots of people had to know about this. They explain how engineers are good at optimizing for a known condition, the standard emissions test driving cycle. The code is a literal implementation of an electronic circuit rather than traditional flow control based code. They detect the driving cycle and switch which emissions model they use in the S/W which ends up under injecting urea, hence increased emissions.

I should also note that these are Germans looking at a Euro market car. The US emissions code may be even more sneaky.

This may explain why euro mpg estimates are so much higher than US ones.
